Claire acted for two employees of a nationally known private company, who were both dismissed (by an outside contracted HR company) for gross misconduct on the basis of a conversation outside of work.
With Claire's assistance, one employee appealed using the company's internal appeals procedure. The employee was found to have been unfairly dismissed. The employers then purported to instigate a fresh disciplinary procedure on fresh allegations. Claire successfully argued that this new determination was also constructively unfair.
The second employee pursued her claim in the employment tribunal, which was also settled a week before the hearing.
The overall settlement was in excess of £60,000.
